Rominger said one of the things he and Amendola will focus on is prosecutor Joe McGettigan’s closing statement about how Sandusky could have said more during the trial. Rominger said that everyone is entitled to the right to remain silent under the Fifth Amendment of the U.S. Constitution, and that any statement made against that is inappropriate to make.

Rominger said Sandusky could also be entitled to a new trial if they can prove the defense didn’t have enough time to prepare for trial.

“I can get three continuances for a parking ticket but I can’t get one for Sandusky,” Rominger said.

Amendola also talked about how the defense did not have enough time to prepare, even to the point where they had to halt their investigation of events to prepare for trial.

Sandusky has the right to file an appeal within 10 days, which senior Judge John Cleland has 120 days to respond to, according to court documents. If he does not respond to the motions filed within those 120 days, it is assumed they are denied, according to court documents.

Sandusky may also file an appeal with the Superior Court of Pennsylvania within 30 days, according to court documents.

Among the appeals Sandusky can make include motioning for a new trial, motioning for a modification of his sentence, motioning to challenge the legality of his sentence and motioning to challenge the jurisdiction of the court, according to court documents.

McGettigan also addressed the press after the sentencing, saying Sandusky is completely detached from reality — speaking in relation to Sandusky’s statement made in court today in which he denied he committed any of the acts he was convicted of.

“He has denied the existence of overwhelming evidence against him,” McGettigan said. “He suffers from a banal self-delusion, completely untethered from reality.”

McGettigan also said the investigation into Sandusky is ongoing and that he could not comment further on the investigation.
