Prosecution asks to seal documents after ‘inadvertently publish[ing]’ names of those involved in Sandusky case

By Mindy Szkaradnik

The prosecution in the Jerry Sandusky case filed a motion Tuesday asking for the judge to seal a document that was “inadvertently published” that listed numerous names of individuals “associated with the investigation of this matter.”

Senior Judge John Cleland approved this request and the document listing names of some of the people referred to as “victims” and others involved in the case was removed from the Centre County website.

Cleland also denied requests to seal three motions that various departments asked to be sealed in order to protect the identities of those who say they were abused by the former Penn State defensive coordinator.

Sandusky is charged with 52 counts of child sex abuse involving 10 boys he met through the charity he founded for underprivileged children, The Second Mile.

The Pennsylvania Department of Labor and Industries requested to seal its motion to quash a subpoena issued by Sandusky’s attorneys, and Cleland denied them of this request. The department also asked for the judge to view the evidence in private and a protective order to be issued.

They asked for this because the department is “concerned” that some of the information in the motion, when added to the information that is already known, may enable people to identify some of the people who say Sandusky abused them. According to the document, the motion to quash the subpoena does not include the names or identifying information of those identified as “Victims 1-10.”

Cleland also denied the Department of Corrections’ motion to seal its earlier request to quash the defendant’s subpoena. The department is also concerned that the motion will make it easier to identify those who say Sandusky abused them, though it also does not include any identifying information.
