Jerry Sandusky’s lawyer looks to postpone trial

Jerry Sandusky’s attorney is looking to postpone the former assistant football coach’s trial until mid-July 2012 — months after the originally proposed trial date of May 14 by Senior Judge John Cleland, who is presiding over the case — because he wants more time to prepare for the trial.

The Commonwealth of Pennsylvania does not object to the request to push back the trial date, according to a motion filed Monday.

Joe Amendola, Sandusky’s attorney, wrote in the motion that due to the large amount of information involved in the case, he needs more time to prepare Sandusky’s defense.

According to the motion, Sandusky’s defense team needs more time to locate potential witnesses whose names were provided to them by the Commonwealth, since the addresses and phone numbers were not provided in the document.

After receiving pretrial materials, Amendola wrote in the motion that he needs more time to subpoena the people and agencies outlined in the materials so he can conduct interviews and make arrangements for expert witnesses.

Some of the expected witnesses will not be available to testify in May, according to the motion, which “will critically and adversely impact [Sandusky’s] defense.”

In the motion, Amendola also asked the court to extend the time for him to file an omnibus pretrial motion to March 22.

Amendola has also asked to extend the time to file a reply to the Commonwealth’s response to his Application for a Bill of Particulars since he will be outside of Pennsylvania from March 2 to March 8.

He is also asking for more time to file a response to request for pretrial discovery materials on or before March 16. Cleland ordered the defense to reply by Monday if they choose to reply.

The Commonwealth does not object to the request for additional time, according to the motion.

The court ordered that all omnibus pretrial motions be filed before March 1, but according to the motion, Amendola said he will need more time to prepare a pretrial motion due to the large number of materials.
